Echoo Education Terms & Conditions

Effective date: 1 January 2027

1. About Echoo Education

Echoo Education is a school management platform operated by Hi Tech Xperts Proprietary Limited, trading as Echoo Education, registered in Botswana under registration number BW00002568917.

In these Terms, “we”, “us” and “our” refer to the operator of Echoo Education. “You” refers to the school, administrator, staff member, student, parent, guardian or other authorised person using our services.

These Terms govern access to our website, mobile applications, portals and related services.

2. Acceptance of these Terms

By accepting these Terms during registration or when prompted within the platform, you agree to comply with them.

Anyone registering a school or purchasing a subscription on its behalf must have authority to represent that school and enter into the agreement.

Students who are minors must access the platform through arrangements authorised by their school and, where required, their parent or legal guardian. Using the platform does not make a student responsible for the school’s subscription charges.

3. Our services

Echoo Education provides tools to help schools manage administration, academic activities and communication with staff, students and families.

Available features depend on the school’s subscription, enabled modules, user permissions and platform version. These may include attendance, timetables, assignments, assessments, fee records, announcements and transport administration.

Features announced for future development are not guaranteed to be available within a particular subscription or timeframe. Additional services, customisations and dedicated school applications are included only where expressly agreed.

Schools remain responsible for educational decisions, student supervision, safeguarding and the services they provide.

4. Accounts and security

Users must provide accurate information and keep their account details current.

You must protect your login credentials, use only accounts you are authorised to access and report suspected misuse promptly. You must not impersonate another person or attempt to access another user’s or school’s records without permission.

Schools are responsible for assigning appropriate permissions and reviewing access when staff or students leave or change roles.

Account and security concerns should be reported to your school administrator or notifications@echoo.co.bw.

5. Responsibilities of schools

Schools are responsible for:

  • Maintaining accurate student, staff, academic and financial information.
  • Having a lawful basis for collecting and sharing personal information.
  • Providing required privacy notices and obtaining consent where necessary.
  • Verifying authorised parent or guardian access.
  • Assigning and reviewing user permissions.
  • Correcting inaccurate records.
  • Communicating school rules, fees and academic requirements.
  • Retaining records required for their educational and administrative obligations.

Schools must use the platform in accordance with applicable law.

6. Responsibilities of individual users

Teachers and staff must use the platform within their assigned responsibilities and protect confidential information.

Students must follow their school’s rules concerning assignments, assessments and communication.

Parents and guardians must keep their contact details current and notify the school of changes affecting their child’s records or their authority to access those records.

Questions about grades, attendance, school fees or school decisions should first be directed to the relevant school.

7. Acceptable use

You must not use the platform to:

  • Conduct unlawful or fraudulent activities.
  • Harass, threaten, bully or discriminate against others.
  • Upload unlawful, harmful or rights-infringing material.
  • Disclose confidential information without authority.
  • Introduce malicious software or disrupt the service.
  • Bypass security controls or access records without permission.
  • Use personal information for unauthorised marketing.
  • Copy, resell or distribute protected platform materials without permission, except where permitted by law.

We may investigate suspected misuse and take proportionate action to protect users and the platform.

8. Subscriptions and payments

The selected subscription, order or written agreement will specify applicable charges, billing periods, included features and usage limits.

Implementation, customisation, dedicated school applications and other additional services may carry separate charges. These will be disclosed before purchase.

Payments must be made using the agreed method and within the agreed payment period. Any automatic renewal arrangement must be disclosed and agreed before it applies.

Changes to recurring charges will be communicated before taking effect and will not retrospectively alter a subscription period already paid for.

Fees charged by a school to parents or students are separate from charges payable to Echoo Education. Schools are responsible for explaining and administering their own fees.

9. Cancellation and refunds

Cancellation and refund arrangements are governed by the terms disclosed at purchase, the applicable Refund & Cancellation Policy and any separate written agreement, subject to applicable law.

Cancelling a subscription does not automatically remove amounts already due. Refund requests will be assessed under the applicable agreement and legal requirements.

Requests concerning tuition, school transport or other school-provided services must be directed to the school concerned.

Nothing in these Terms removes refund or cancellation rights that cannot lawfully be excluded.

10. Privacy and personal information

Our Privacy Policy explains how personal information is collected, used, shared and retained, and how individuals can exercise their rights.

For school records processed on a school’s instructions, the school generally determines the purposes of processing, while Echoo Education processes the information to provide the agreed services.

We may separately process information for account administration, billing, security and support, as described in our Privacy Policy.

Schools must provide personal information lawfully. Accepting these Terms does not replace any separately required consent.

Where applicable, a data processing agreement will set out processing instructions, confidentiality, security, service-provider arrangements and responsibilities when the service ends.

11. Content and intellectual property

Schools and users retain their existing rights in content they upload. They authorise us to host, process, transmit and display that content as necessary to provide the services, follow authorised instructions and fulfil legal obligations.

The platform’s software, branding and other protected materials belong to Echoo Education or its licensors.

Authorised users receive limited permission to use the platform for its intended purposes during their permitted access period. These Terms do not transfer ownership of the software or branding.

12. Availability, maintenance and updates

We will exercise reasonable care in providing the services. Access may occasionally be interrupted by maintenance, updates, connectivity problems or circumstances beyond our reasonable control.

Uninterrupted availability is not guaranteed unless expressly provided in a separate written agreement.

Where practicable, we will give advance notice of planned material interruptions. Updates may change how features operate. Material changes to contracted services will be handled in accordance with the applicable agreement and law.

Users may need to update their mobile applications to continue accessing supported features.

13. Communications and notifications

The platform may deliver school notices and service-related messages through supported communication channels.

Delivery may depend on internet access, device permissions, accurate contact details and third-party services. Notifications may be delayed or unsuccessful.

Schools and users should use appropriate alternative communication methods for urgent matters. Echoo Education is not an emergency response service.

Marketing communications, where used, will be managed separately from essential account and service notifications.

14. Third-party services

Some features may depend on external services, including hosting, maps, messaging, payment processing and app stores.

These services may have their own terms and privacy policies. Their availability may affect related platform features.

Using external providers does not remove our responsibilities under our agreement with you or applicable law.

15. Suspension and termination

We may restrict or suspend access where reasonably necessary to address serious misuse, security risks, legal requirements or overdue subscription payments.

Where practicable, we will explain the reason and provide an opportunity to resolve the issue. Immediate action may be necessary where continued access creates a material risk.

Schools may manage or terminate individual user access within their authority and applicable policies.

Concerns about restrictions imposed by Echoo Education may be sent to notifications@echoo.co.bw.

16. Records when access ends

Schools should arrange to export records they need before their subscription ends.

The applicable service agreement will specify the export process, any assistance charges and the period during which records remain available after termination.

Retention and deletion will follow the Privacy Policy, lawful school instructions and applicable legal obligations.

Closing an individual account does not necessarily require deletion of records that must lawfully be retained.

17. Responsibility and liability

Each party remains responsible for its own acts and omissions to the extent required by applicable law.

Echoo Education does not guarantee particular academic outcomes, successful fee collection or the correctness of decisions made by schools using the platform.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or restricts mandatory consumer or data protection rights.

18. Changes to these Terms

We may revise these Terms to reflect changes to our services or legal requirements.

We will publish the revised Terms with an updated effective date and provide reasonable notice of material changes. Where fresh acceptance is required, we will request it.

Changes will not retrospectively remove rights that have already arisen.

19. Governing law and complaints

These Terms are governed by the laws of Botswana, subject to any mandatory protections applicable to users.

Please contact us first so we can attempt to resolve a complaint. If the matter remains unresolved, either party may seek assistance from a competent regulator or court.

Nothing in these Terms prevents a person from exercising their legal rights.
